These Gift Card Terms (“Gift Card Terms”) apply to all gift cards issued by Canary Connect, Inc. (“Canary”, “we”, or “us”). They supplement and form part of Canary’s Sales Terms located at https://canary.is/legal/sales-terms. By purchasing, accepting, or using a Canary gift card (“Gift Card), you agree to these Gift Card Terms. If you do not agree, do not purchase or use the Gift Card. In the event of any conflict between these Gift Card Terms and the Sales Terms, these Gift Card Terms control for issues specific to Gift Cards.

Canary Gift Cards are redeemable for all full priced Canary products and services and are not eligible for use on promotional items. This means you can apply the Gift Card toward the purchase of any Canary devices, accessories, subscriptions (such as premium or professional monitoring services), or other offerings available through canary.is. Gift Cards may be redeemed only via Canary’s website (canary.is), and only for transactions in the United States. If your purchase total exceeds the remaining Gift Card balance, you must pay the difference with another payment method. If you use a Gift Card for a purchase and do not use the full balance, any unused balance will remain on the Gift Card for future use.

Limitations: Gift Cards cannot be used to purchase other gift cards, reloaded with additional value, or redeemed for cash (except where required by law). Gift Cards are intended for consumer use; they may not be resold, transferred for value, or used for unauthorized advertising, marketing, sweepstakes, or other promotional purposes. Canary reserves the right to refuse, cancel, or hold for review any Gift Card transaction suspected to be fraudulent, abusive, or in violation of these Gift Card Terms.

Gift cards sold by Canary are valid for five years from the date of issuance or last load. If your state of residence prohibits this expiration on gift certificates, then your Gift Card will expire at the earliest date permitted by applicable law.

Canary Gift Cards do not carry any service, inactivity, or maintenance fees and none will be charged against the card balance. The full value you pay for remains available until it is spent or expired. These Gift Card Terms will be interpreted in compliance with applicable federal and state regulations, including the federal Credit CARD Act of 2009 and Federal Trade Commission (FTC) gift card rules that protect consumers (e.g. restrictions on expiration and fees). Disclosures of any material limitations or applicable fees (if any ever were imposed) will be made in accordance with those laws.

No Refunds: Gift Cards are not returnable or refundable for cash or credit, except in those circumstances where required by law. Once purchased, the Gift Card value is locked to that card and cannot be transferred back to money (e.g., you generally cannot “cash out” a Gift Card or get a refund of the remaining balance to your credit card). Please treat a Gift Card like cash and ensure you intend to use it for Canary products or services before purchase, as all sales of Gift Cards are final.

Cash Redemption Requirements (U.S. jurisdictions): While Canary’s standard policy is no cash refunds, certain U.S. states require gift card issuers to provide cash back on remaining small balances. Canary will comply with all such laws. Specifically, if your Gift Card balance falls below a state-mandated threshold, you may request a cash payout of the remaining balance in that state.

If you believe your Gift Card balance qualifies for cash-out under applicable law, please contact support@canary.is with your Gift Card details and state of residence. We may require proof of residence or other information as allowed by law before processing a cash redemption. Canary will process eligible cash redemption requests as required by each state’s law (for example, by issuing a check or electronic payment for the small remaining balance if all conditions are met). Outside of these legally mandated scenarios, Gift Card balances will be used only to purchase Canary products/services and will not be exchanged for cash.

Risk of Loss: The risk of loss and title to a Gift Card passes to the purchaser upon electronic transmission of the Gift Card code to the purchaser or designated recipient, or at the point of physical delivery (if applicable) to the carrier for mailing. Thereafter, you (or the designated recipient) are solely responsible for safeguarding the Gift Card and its code from loss, theft, or unauthorized use. Canary is not responsible if a Gift Card is lost, stolen, destroyed, or used without your permission. Treat your Gift Card like cash and do not share the code except with the intended user. Lost or stolen Gift Cards will not be replaced or refunded by Canary to the maximum extent permitted by law (note: under U.S. law, unlike credit cards, issuers are generally not required to replace lost or stolen gift cards). If you suspect that someone has copied, stolen, or gained unauthorized access to your Gift Card, contact Customer Support immediately; however, please understand that Canary cannot guarantee replacement or reimbursement in such cases.

Fraud and Abuse: Canary assumes no liability for any unlawful conduct, fraud, or scam related to Gift Cards by third parties. Be wary of anyone claiming that you need to pay them with a Canary Gift Card – this is a common scam technique, and Canary is not responsible for losses in such cases. We reserve the right to decline or cancel Gift Card orders, or to disable or reject redemption of Gift Cards, if we reasonably suspect fraud, mistake, alteration, tampering, or any violation of these terms. Canary may suspend or terminate your ability to purchase or redeem Gift Cards if we detect suspicious activity or misuse of the Gift Card system. This includes cases of systematic resale, use of bots or false identities to acquire Gift Cards, or any fraudulent behavior. Misuse of a Gift Card or violation of these Gift Card Terms may result in the Gift Card being voided (cancelled) without reimbursement, as permitted by law.

Integration with Other Terms: These Gift Card Terms are incorporated into, and form part of, Canary’s Sales Terms located at https://canary.is/legal/sales-terms. All applicable Canary terms (such as limitations of liability, governing law, dispute resolution, and arbitration agreements, if any) that are set forth in those sales terms apply equally to your purchase or use of Gift Cards, to the extent not inconsistent with these Gift Card-specific provisions. Further, all sales and use of Gift Cards are subject to applicable U.S. federal and state laws and regulations, and nothing in these terms is intended to limit your legal rights or Canary’s legal obligations under those laws. If any provision of these Gift Card Terms is found to be invalid or unenforceable under applicable law, that provision will be applied in the manner that most closely reflects the original intent and complies with the law, and all other provisions will remain in full force and effect.

Changes to Terms: Canary reserves the right to change or update these Gift Card Terms at any time, in its sole discretion, in accordance with applicable law. If we make material changes, we will provide notice by posting the updated terms on our website (and updating the “Updated” date above) or by other reasonable means. Your purchase or use of any Gift Card after such update constitutes your acceptance of the revised terms. If you do not agree to the changes, you should not purchase or continue to use any Gift Cards issued after the effective date of the updated policy.
